The complainant has requested the university to disclose information relating to a pilot 11+ test carried out with schools in Buckinghamshire. The university released some information but felt the majority of information is exempt from disclosure under sections 40 and 43 of the FOIA. The Commissioner has reviewed the withheld information. He is satisfied that sections 40 and 43 of the FOIA apply to all remaining withheld information except columns F and G of the spreadsheet containing all scores across the entire test (the withheld information relevant to question one of the information request). The Commissioner therefore requires the university to disclose columns F and G detailing the school and venue, contained in the spreadsheet it provided in relation to question one of the complainant’s information request. The university must take these steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
