The complainant requested information about a particular planning application. Despite the intervention of the Commissioner, Rhondda Cynon Taf County Borough Council (‘the Council’) has not provided an adequate response to the request. The Commissioner requires the public authority to provide the complainant with a response to his request which complies with the requirements of the EIR. The public authority must take this step steps within 35 calendar days of the date of this decision notice. Failure to comply may result in the Commissioner making written certification of this fact to the High Court pursuant to section 54 of the Act and may be dealt with as a contempt of court.
