The complainant has requested legal advice relating to a planning application. Durham County Council refused the request under the exception to adverse affect to the course of justice (regulation 12(5)(b). The Commissioner’s decision is that Durham County Council has correctly withheld the information under regulation 12(5)(b) and that the public interest favours maintaining the exception. The Commissioner does not require the public authority to take any steps.
