The complainant made a freedom of information request to Selby District Council for copies of an email containing representations relating to a planning application heard at the Council’s Planning Committee on 7 September 2016. In response the Council said that the requested information was not held. The Commissioner’s decision is that on the balance of probabilities the requested information is not held and the Council dealt with the complainant’s request in accordance with FOIA. The Commissioner requires no steps to be taken.
