Police and Crime Commissioner for West Yorkshire
The complainant requested information relating to the Chief Constable of West Yorkshire Police’s role as Service Director for the College of Policing’s Strategic Command Course. The Office of the Police and Crime Commissioner for West Yorkshire (OPCC) denied holding some information within the scope of the request. It disclosed some information but refused to provide the remainder, citing section 40 (personal information) of the FOIA as its basis for doing so. The Commissioner investigated the OPCC’s application of sections 40(1) and 40(2). She also considered whether, on the balance of probabilities, it held further information within the scope of the request. The Commissioner’s decision is that the OPCC correctly applied the provisions of section 40(1) to withhold the information withheld by virtue of that exemption. She also concluded that the OPCC correctly applied the provisions of section 40(2) to withhold the information withheld by virtue of that exemption. She determined that, on the balance of probabilities, the OPCC did not hold the further information within the scope of the request. The Commissioner requires no steps to be taken as a result of this decision.
