Crown Prosecution Service

The complainant has requested information about the costs incurred in a judicial review. The Crown Prosecution Service refused the request because it argued that it had responded to the same request already. The Commissioner’s decision is that the CPS was not entitled to rely on section 14(2) of the FOIA to refuse the request. The Commissioner requires the CPS to take the following steps to ensure compliance with the legislation: issue a fresh response, to the request, which does not rely on section 14(2) of the FOIA.
