The London Borough of Ealing (the “Council”) refused to confirm or deny whether it held this information citing section 40 (personal data exemption) as its basis for doing so. The Commissioner’s decision is that the Council is entitled to refuse to confirm or deny whether it holds the requested information. No steps are required.
