Haberdashers’ Aske’s Federation Trust

The complainant has requested information about the content of particular lessons. Haberdashers’ Aske’s Federation Trust provided some information, denied holding some of the requested information and withheld the remainder, relying on section 41 (breach of confidence), section 43 (commercial interests) and section 40(2) of FOIA (third party personal data). The Commissioner’s decision is that the Trust was entitled to rely on section 41 of FOIA to withhold the information within the scope of element [1]. The Commissioner’s decision is that the Trust was entitled to rely on section 43 of FOIA to withhold the information within the scope of element [1] and the balance of the public interest favours maintaining this exemption. The Commissioner considers that the Trust was also entitled to rely on section 40(2) of FOIA to withhold the information within the scope of elements [5], [6] and [7]. Finally, the Commissioner is satisfied that the Trust does not hold any further information within the scope of element [3]. The Commissioner does not require any further steps.
