The complainant submitted a two part request to the House of Commons (‘HoC’) asking for information relating to an investigation into complaints about the behaviour of attendees of an event at the Palace of Westminster in October 2021.The HoC relied on section 34(1) (Parliamentary privilege) of FOIA to refuse to respond to the first part of the request request and also stated it did not hold information falling within the scope of the second part of the request.The Commissioner is satisfied that, on the balance of probabilities, the HoC does not hold information in the second part of the request as it is not held in recorded form and that the HoC can rely on section 34(1) of FOIA to refuse to provide any information falling within the scope of the first part.
