Kirklees Metropolitan Council

The complainant requested from Kirklees Metropolitan Council (the “Council”) information contained in user evidence forms provided to the Council by witnesses as to the long-term use of a claimed public right of way. The Council relied on regulation 13 of the EIR (personal information) to withhold some of the information. The Commissioner’s decision is that the Council applied regulation 13(1) of the EIR. The Commissioner requires no steps to be taken.
