Rushmoor Borough Council

The complainant has requested information from Rushmoor Borough Council (“the Council”) in relation to the current medical referee’s registration number. The Council has withheld the requested information, relying on section 40(2) of FOIA – personal information. The Commissioner’s decision is that the Council is entitled to rely on section 40(2) of FOIA to withhold the requested information. However, as the Council failed to respond to the request for information within 20 working days, it has breached section 10(1) of FOIA. The Commissioner does not require the public authority to take any steps as a result of this decision notice.
