The opposition was based on the opponents’ UK registrations of their mark SUPREDOL, in Class 5. Considering this matter under Section 5(2)(b) the Hearing Officer found the goods to be identical but considered that the ‘superficial similarities’ between the marks were "more than counterbalanced by the differences" and all factors considered there was no realistic likelihood of confusion. The opposition failed.
