Summary
In opposition proceedings the hearing officer admitted an amended counter-statement filed by the proprietors one day after the original version, and on the last day of the extended period under rule 40(4) agreed between the parties. The hearing officer did not accept the opponents contention that the later counter-statement was not allowable in the light of the wording of rule 40(4) and the decisions Marshals Application [1969] RPC 83 and Concrete Repairs Patent (BL O/67/97).
