Costs, from the standard scale, awarded to the applicant.
Points Of Interest
Summary
After some to-ing and fro-ing involving the opponent, the Registry and the applicant an opposition was withdrawn, at first conditionally, but as this was not acceptable to the Registry, then unconditionally.
The applicant subsequently asked for an award of costs, which was agreed. The Registry in a ‘preliminary view’ indicated that it would make an award based on the usual scale of costs. The applicant asked for this to be referred to a Hearing Officer and, when the Hearing Officer upheld the preliminary view, asked for a statement of her reasons.
This decision set out those reasons.
