Summary
The defendant requested that the reference under section 8 (now under section 35) be stuck out. The reasons given included that the claimant had delayed launching entitlement proceedings, had not filed any evidence and had misrepresented the invention in its statement of claim. The request to strike out was refused and the defendant ordered to pay costs.
