Summary
An entitlement reference under section 37 was made after the two-year deadline allowed for doing so. In a preliminary decision on the question of the whether an order under section 37 could be made out of time, the hearing officer found that there was no evidence to show that the patentee knew that it was not entitled to grant of the patent at the time of grant.
