Secretary of State for Work and Pensions v PE and Bolton Metropolitan Borough Council (HB) (Housing and council tax benefits - other) [2017] UKUT 393 (AAC) (4 October 2017)


The First-tier Tribunal found that regulation B13 of the Housing Benefit Regulations 2006 was discriminatory, by analogous with foster carers, for failing to make provision for rooms vacant while the claimant was waiting to accommodate a person under the adult placement scheme. The Upper Tribunal rejected the Secretary of State's grounds of appeal.
