SS v Cornwall Partnership NHS Foundation Trust (Mental Health) [2023] UKUT 258 (AAC) (22 October 2023)


Licence revoked as a result of significant maintenance failings by this Public Service Vehicle operator, providing transport for school children. Sustained failings despite previous unsatisfactory maintenance investigation and a preliminary hearing in which undertakings given. Both the operator and the transport manager lost their good repute and the transport manager was disqualified for one year and until he retook the Certificate of Professional Competence. Both decisions proportionate. Appeals dismissed.
