    And upon the tribunal having determined to proceed with the appeal under rule 26(2) of the Tribunal Rules and having announced its decision and with the Respondents' agreement under rule 20(80) of the Tribunal Rules, the tribunal directs:

  1. That this appeal is dismissed, there being no reasonable excuse for the default which gave rise to the surcharge of £269.56 in respect of the period ending July 2007 that being the surcharge under appeal
