The Oil in Navigable Waters (Transfer Records) Regulations, 1957

The Minister of Transport and Civil Aviation in exercise of his powers under subsections (2) and (3) of Section 7 of the Oil in Navigable Waters Act, 1955, and of all other powers him enabling in that behalf hereby makes the following Regulations:-

1.-(1) These Regulations shall come into operation on the first day of April, 1957, and may be cited as the Oil in Navigable Waters (Transfer Records) Regulations, 1957.

(2) The Interpretation Act, 1889, shall apply to the interpretation of these Regulations as it applies to the interpretation of an Act of Parliament.

2. These Regulations shall apply to every vessel, whether registered or not, and of whatever nationality, which is capable of carrying in bulk, whether for cargo or for bunker purposes, more than twenty-five tons of oil, or which, though not so capable is constructed or fitted to carry in bulk as aforesaid more than five tons of oil in any one space or container.

3.-(1) Subject to the provisions of paragraph (2) of this Regulation there shall be kept by the master of every vessel to which these Regulations apply a record of the particulars specified in Regulation 4 hereof relating to the transfer of oil to and from the vessel while it is within the seaward limits of the territorial waters of the United Kingdom.

(2) In the case of the transfer of oil to a barge the records shall be kept by the person supplying the oil and in the case of the transfer of oil from the barge the record shall be kept by the person to whom the oil is delivered.

4.-(1) The record required to be kept by Regulation 3 of these Regulations shall show clearly the following particulars:-

(i)The name and port of registry (if any) of the vessel or barge;

(ii)The date and time of transfer;

(iii)The place of transfer;

(iv)The amount and description of oil transferred;

(v)From what vessel, barge or place on land, and to what vessel, barge or place, the oil was transferred.

(2) The record of each operation shall be separately signed and dated by the master or such other person as is referred to in Regulation 3 of these Regulations.

(3) If the record is kept in the Official Log of a vessel it shall not be necessary separately to state the name and port of registry (if any) of the vessel.

5. The Oil in Navigable Waters (Records) Order, 1923(1), is hereby revoked.

EXPLANATORY NOTE

These Regulations apply to a certain class of vessel of whatever nationality and require records to be kept of transfers of oil to and from such a vessel while it is within the territorial waters of the United Kingdom.
