PLANT BREEDERS' RIGHTS

The Queen's Most Excellent Majesty in Council
Her Majesty, in pursuance of the power conferred upon Her by section 40 of the Plant Varieties and Seeds Act 1964, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-
1. This Order may be cited as the Plant Varieties and Seeds (Isle of Man) Order 1969 and shall come into operation on 1st January 1970.
2. The provisions of Part I (Plant Breeders' Rights), and of Part IV (General) in its application to the said Part I, of the Plant Varieties and Seeds Act 1964, as extended by the Plant Varieties and Seeds (Northern Ireland) Order 1964(1) and as amended by section 43 of, and the first entry in Schedule 7 to, the Agriculture (Miscellaneous Provisions) Act 1968, shall extend to the Isle of Man subject to the exceptions, adaptations and modifications specified in the Schedule to this Order.

1. In section 4(1)(b) and (2) for the words "Great Britain" wherever they occur there shall be substituted the words "the Isle of Man" .
2. In section 5A(2) for the words "Great Britain" there shall be substituted the words "the Isle of Man" .
3. Section 8 shall be omitted.
4. In section 10(5)(a) for the words "in which part of Great Britain" there shall be substituted the words "where in the Isle of Man".
5. Section 14(2) and (3) shall be omitted.
6. Section 35(2) shall be omitted.
7. In section 36(b) the words "Minister or" shall be omitted.
8. Section 37 shall be omitted.
9. In section 38(1) for the definitions of "the Minister" and "the Ministers" there shall be substituted the following definition:-
"`"the Ministers" means
10. Section 41(2) shall be omitted.
11. In Schedule 1 , in paragraph 1(2) for the words "United Kingdom" there shall be substituted the words "Isle of Man".
12. In Part I of Schedule 2, in paragraph 2(2) after the words "United Kingdom" there shall be inserted the words "and the Isle of Man" and in paragraph 2(7) after the words "United Kingdom" in the first place where they occur there shall be inserted the words "and the Isle of Man" and after those words in the second place where they occur there shall be inserted the words ", the Isle of Man".
13. In Part II of Schedule 2, in paragraph 2(1) and in paragraph 2(2) before the proviso after the words "United Kingdom" there shall be inserted the words ", the Isle of Man" and after those words in the proviso there shall be inserted the words "and the Isle of Man".
14. In Schedule 3 , in paragraph 1(1) for the words "Great Britain" there shall be substituted the words "the Isle of Man".
15. In Schedule 4 , in paragraph 8(7) for the words "Great Britain" there shall be substituted the words "the Isle of Man".
This Order extends Part I of the Plant Varieties and Seeds Act 1964 (plant breeders' rights) and the general provisions relating to that Part to the Isle of Man with exceptions, adaptations and modifications.
