The Tokyo Convention Act 1967 (Jersey) Order 1969

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by section 8 of the Tokyo Convention Act 1967 and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-

1. This Order may be cited as the Tokyo Convention Act 1967 (Jersey) Order 1969 and shall come into operation on 1st May 1969.

2. In this Order the expression "Jersey" shall mean the Bailiwick of Jersey and the territorial waters thereof.

3. The Interpretation Act 1889shall apply for the purpose of the interpretation of this Order as it applies for the purpose of the interpretation of an Act of Parliament.

4. Sections 1(1) and (3), 3, 4, 5(1) to (3) and (5), 6(1), 7, 8 and 9(1) and (2) of the Tokyo Convention Act 1967 shall extend to Jersey with the exceptions, adaptations and modifications specified in the Schedule to this Order.

SCHEDULEEXCEPTIONS, ADAPTATIONS AND MODIFICATIONS IN THE TOKYO CONVENTION ACT 1967

1.-(1) Any reference to the Civil Aviation Act 1949 shall be construed as a reference to that Act as extended to Jersey by the Civil Aviation Act (Channel Islands) Order 1953(1) and the Civil Aviation (Channel Islands) Order 1966(2).

(2) Any reference to the Civil Aviation (Licensing) Act 1960 shall be construed as a reference to that Act as extended to Jersey by the Civil Aviation (Licensing) Act 1960 (Channel Islands) Order 1961(3) and brought into force, as so extended, by the Civil Aviation (Licensing) Act 1960 (Channel Islands) (Commencement) Order 1964(4).

2. In section 1 for the words "the United Kingdom" wherever those words occur there shall be substituted the word "Jersey" and the words "or in a part of" (in both places), "or in that part of" and "(or, as the case may be, in that part thereof)" shall be omitted.

3.-(1) In section 3(1) for the words "the United Kingdom" there shall be substituted the word "Jersey".

(2) In section 3(5)(b) for sub-paragraphs (i) and (ii) there shall be substituted the following sub-paragraphs:-

"(i)in Jersey, to a police officer or aliens officer; or

(ii)in any other country which is a Convention country, to an officer having functions corresponding to the functions in Jersey either of a police officer or of an aliens officer.".

(3) In section 3(6) for the words "the United Kingdom" in the first two places where those words occur there shall be substituted the word "Jersey";

and for sub-paragraph (i) of paragraph (b) there shall be substituted the following sub-paragraph:-

"(i)where the country in question is Jersey to a police officer or an aliens officer or, in the case of any other country, to an officer having functions corresponding to the functions in Jersey either of a police officer or of an aliens officer;".

4. In section 4 for the words "the United Kingdom" there shall be substituted the word "Jersey".

5. In section 5(1) for the words "the United Kingdom" except where those words last occur there shall be substituted the word "Jersey".

6. In section 6(1) in paragraph (a) after the words "any such Order in Council," there shall be inserted the words "or by the Harbours and Airports Committee" and the words "and in Scotland sufficient evidence" shall be omitted.

7.-(1) In section 7(1) in paragraph (b)(ii) of the definition of the expression "British-controlled aircraft" for the words "the United Kingdom" there shall be substituted the word "Jersey".

(2) In section 7(2) for the words "the United Kingdom" there shall be substituted the word "Jersey" and for the words "a constable" there shall be substituted the words "a police officer".

(3) In section 7(3) the words from "and references to a part" to the end of the subsection shall be omitted.

(4) For section 7(5) there shall be substituted the following subsection:-

"(5) Any regulations or order made by the Board of Trade under this Act shall not come into force in Jersey until registered by the Royal Court.".

8. For section 9(2) there shall be substituted the following subsection:-

"(2) This Act and the Civil Aviation Acts 1949 and 1960 may be cited together as the Civil Aviation Acts 1949 to 1967.".

EXPLANATORY NOTE

This Order extends the Tokyo Convention Act 1967 to the Bailiwick of Jersey with exceptions, adaptations and modifications (apart from section 2 (provisions as to extradition) which applies of its own force).
