The Minister for the Civil Service, in exercise of the powers conferred on him by Schedule 1 to the Parliamentary Commissioner Act 1967, as amended by section 29(1) of, and paragraphs 63 and 64 of Schedule 6 to, the Superannuation Act 1972, and of all other powers enabling him in that behalf, hereby makes the following Regulations:-
1. These Regulations may be cited as the Parliamentary Commissioner's Pension (Amendment) Regulations 1972, and shall come into operation on 20th April 1972.
2.-(1) In these Regulations "the principal Regulations" means
(2) The Interpretation Act 1889 shall apply for the interpretation of these Regulations as it applies for the interpretation of an Act of Parliament.
3. In Regulation 2 of the Principal Regulations (Parliamentary Commissioner electing for the civil service scheme) the following paragraph shall be added after paragraph (3):-
"(4) Any reference in this Regulation to the Superannuation Act 1965 or to section 13 of that Act shall be construed as a reference to the provisions of that Act or that section, as the case may be, as having effect, by virtue of section 2(12) of the Superannuation Act 1972, as part of the civil service scheme."
4. In Regulation 5(1) of the principal Regulation (interpretation), for the definition of "the civil service scheme", there shall be substituted the following definition:-
""the civil service scheme" means

These Regulations amend the Parliamentary Commissioner's Pension Regulations 1967. The Parliamentary Commissioner has the right to elect, in accordance with those Regulations, between two statutory pension schemes: the judicial scheme and the civil service scheme. Under the Superannuation Act 1972 the statutory civil service scheme is to be replaced by a scheme set out in non-statutory documents. These Regulations make the necessary consequential amendments to the 1967 Regulations.
