The Civil Evidence Act 1972 (Commencement No. 1) Order 1974

21st February 1974

The Lord Chancellor, in exercise of the powers conferred on him by section 6(3) of the Civil Evidence Act 1972, hereby makes the following Order:-

1.-(1) This Order may be cited as the Civil Evidence Act 1972 (Commencement No. 1) Order 1974.

(2) The Interpretation Act 1889 shall apply to the interpretation of this Order as it applies to the interpretation of an Act of Parliament.

2. Section 1 and section 4(2) to (5) of the Civil Evidence Act 1972 shall come into force on 1st June 1974 for the purposes of the following civil proceedings:-

(a)proceedings (other than proceedings in bankruptcy) in the Supreme Court;

(b)proceedings before any tribunal, other than the ordinary courts of law, being proceedings to which the strict rules of evidence apply;

(c)arbitrations and references (other than references under section 92 of the County Courts Act 1959, as amended by section 7 of the Administration of Justice Act 1973) to which the strict rules of evidence apply;

(d)applications and appeals arising out of such proceedings as are mentioned in subparagraphs (a) to (c), above.

EXPLANATORY NOTE

This Order brings the Civil Evidence Act 1972 fully into operation on 1st June 1974 for the purposes of civil proceedings in the Supreme Court (except bankruptcy) and of certain other civil proceedings to which the strict rules of evidence apply. The Order does not extend to proceedings in county courts or magistrates' courts.
