ROAD TRAFFIC

The Road Traffic Act 1974 (Commencement No. 6) Order 1975

9th September 1975

The Secretary of State for the Environment in exercise of the powers conferred by section 24(4) of the Road Traffic Act 1974 and of all other enabling powers hereby makes the following Order:-

1. This Order may be cited as the Road Traffic Act 1974 (Commencement No. 6) Order 1975.

2.-(1) On the 1st October 1975 there shall come into operation the provisions of the Road Traffic Act 1974 (hereinafter referred to as "the Act") specified in Column (1) of Schedule 1 to this Order and which relate to the matters respectively specified in relation to these provisions in column (2) of that Schedule to the extent and for the purposes specified in that Schedule.

(2) On the 1st January 1976 there shall come into operation the provisions of the Act specified in Column (1) of Schedule 2 to this Order and which relate to the matters respectively specified in relation to those provisions in column (2) of that Schedule to the extent specified in that Schedule.

SCHEDULE 1PROVISIONS COMING INTO OPERATION ON THE 1ST OCTOBER 1975

Provisions of the Act Subject matter of the provisions
Section 13(1) (so far as that subsection relates to the provisions in Schedule 3 to the Act specified below in this Schedule).Amendments relating to the licensing of drivers.

In Schedule 3-

paragraph 2(1).

paragraph 3 (for the purposes of inserting after section 87 of the Road Traffic Act 1972, subsections (2) to (7) of the new section 87A so far as those provisions relate to prospective disabilities but in relation only to applicants for the grant of licences to take effect on or after 1st January 1976).

paragraph 4(2) (so far as it relates to prospective disabilities but in relation only to applications for the grant of licences to take effect on or after 1st January 1976.

paragraph 5(1) (so far as it amends section 89(1)(a)) of the Road Traffic Act 1972 and 6 (so far as it inserts a new paragraph (b) in section 90(1) of that Act) (in each case in relation only to applications for the grant of licences to take effect on or after 1st January 1976.

paragraph 10(2) and (3).

Amendments to Part III of the Road Traffic Act 1972.

Section 24(3) (so far as that subsection relates to the provisions of Schedule 7 to the Act specified below in this Schedule).Repeals.

In Schedule 7-

the entries relating to the Road Traffic Act 1972, section 104(1), (2), (3) and 6(a), and section 105(2).

Repeals.

EXPLANATORY NOTE

This Order brings into operation the remaining provisions of Section 13 and Schedule 3 to the Road Traffic Act 1974 and related repeals, which were not brought into operation by the Orders referred to in Schedule 2.
