The Counsellors of State in Council
Whereas Her Majesty, in pursuance of the Regency Acts 1937 to 1953, was pleased, by Letters Patent dated the 21st day of July 1978, to delegate to the six Counsellors of State therein named or any two or more of them full power and authority during the period of Her Majesty's absence from the United Kingdom to summon and hold on Her Majesty's behalf Her Privy Council and to signify thereat Her Majesty's approval for anything for which Her Majesty's approval in Council is required:
And whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972 and has been approved by a resolution of each House of Parliament:
Now, therefore, Her Majesty Queen Elizabeth The Queen Mother and Her Royal Highness The Princess Margaret, Countess of Snowdon, being authorised thereto by the said Letters Patent, and in persuance of the powers conferred by section 1(3) of the European Communities Act 1972 and all other powers enabling Her Majesty, do hereby, by and with the advice of Her Majesty's Privy Council, on Her Majesty's behalf order, and it is hereby ordered, as follows:-
1. This Order may be cited as the European Communities (Definition of Treaties) (No. 7) (International Wheat Agreement) Order 1978. It shall come into operation in respect of each treaty specified in the Schedule to this Order on the date on which the treaty enters into force for the United Kingdom. These dates will be notified in the London, Edinburgh and Belfast Gazettes.
2. The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.
3. The treaties specified in the Schedule to this Order are to be regarded as Community Treaties as defined in section 1(2) of the European Communities Act 1972.

1. Protocol for the Fourth Extension of the Wheat Trade Convention 1971, opened for signature at Washington on 26 April 1978 (Cmnd. 7240).
2. Protocol for the Fourth Extension of the Food Aid Convention 1971, opened for signature at Washington on 26 April 1978 (Cmnd. 7240).
This Order declares the 1978 Protocols for the Fourth Extension of the Wheat Trade Convention and the Food Aid Convention constituting International Wheat Agreement 1971 (Cmnd 4953), to be Community Treaties as defined in section 1(2) of the European Communities Act 1972. The International Wheat Agreement 1971 was a Community Treaty by virtue of section 1(2) of the European Communities Act 1972 and this Order ensures that the Protocols which extend its validity will also be Community Treaties.
