Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972 and has been approved by a resolution of each House of Parliament:
Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-
1. This Order may be cited as the European Communities (Definition of Treaties) (International Railway Tariffs Agreements) Order 1982. It shall come into operation in respect of each treaty specified in the Schedule to this Order on the tenth day after the day on which it is made.
2. The treaties specified in the Schedule to this Order are to be regarded as Community Treaties as defined in section 1(2) of the European Communities Act 1972.

1. Protocol between the Federal Council of the Swiss Confederation, the Governments of the Member States of the European Coal and Steel Community and the Commission of the European Communities signed at Brussels on 2nd April 1981 and entering into force on a date to be notified in the London, Edinburgh and Belfast Gazettes (Cmnd. 8363), which is supplementary to the Agreement between the Federal Council of the Swiss Confederation, the Governments of the Member States of the European Coal and Steel Community and the High Authority of the European Coal and Steel Community on the introduction of through international railway tariffs for the carriage of coal and steel through Swiss territory, signed at Luxembourg on 28th July 1956 and which entered into force on 1st June 1957 (Cmnd. 5892).
2. Protocol between the Austrian Federal Government, the Governments of the Member States of the European Coal and Steel Community and the Commission of the European Communities signed at Brussels on 2nd April 1981 and entering into force on a date to be notified in the London, Edinburgh and Belfast Gazettes (Cmnd. 8417), which is supplementary to an Agreement between the Austrian Federal Government, the Governments of the Member States of the European Coal and Steel Community and the High Authority of the European Coal and Steel Community on the introduction of through international railway tariffs for the carriage of coal and steel through the territory of the Republic of Austria, signed at Luxembourg on 26th July 1957 and which entered into force on 1st March 1958 (Cmnd. 5891).
This Order declares the 1981 Protocols to the European Coal and Steel Community Agreements with Switzerland and Austria of 1956 and 1957 on the introduction of through international railway tariffs for the carriage of coal and steel to be Community Treaties as defined in section 1(2) of the European Communities Act 1972. The Protocols enable Greece to accede to the Agreements in accordance with Article 4(2) of the Act concerning the Conditions of Accession of Greece to the Communities (Cmnd. 7650).
The principal effect of declaring the Protocols to be Community Treaties as so defined is to bring into play, in relation to them, the provisions of section 2 of the European Communities Act 1972 which provides for the implementation of Treaties so specified.
