SUPREME COURT OF ENGLAND AND WALES COUNTY COURTS LICENSED CONVEYANCING

The Administration of Justice Act 1985 (Commencement No. 2) Order 1986

1st September 1986

The Lord Chancellor, in exercise of the powers conferred on him by section 69(2) of the Administration of Justice Act 1985, hereby makes the following Order:-

1. This Order may be cited as the Administration of Justice Act 1985 (Commencement No. 2) Order 1986.

2. The following provisions of the Administration of Justice Act 1985shall come into operation on 1st October 1986-

(a)section 13,

(b)section 22,

(c)section 23,

(d)section 38,

(e)section 47,

(f)section 51,

(g)section 55,

(h)section 67(1) so far as it relates to paragraph 7 of Schedule 7, and

(i)section 67(2) so far as it relates to so much of Part III of Schedule 8 as refers to the Supreme Court Act 1981 and the County Courts Act 1984.

EXPLANATORY NOTE

This Order brings into operation on 1st October 1986 the following provisions of the Administration of Justice Act 1985 and their consequential amendments and repeals-

(a)sections 13, 22, 23 and 38: providing rule making powers exercisable by the Council for Licensed Conveyancers to govern the training of persons seeking to practise as licensed conveyancers, the keeping of their accounts and establishment of client accounts, as to interest on clients' money, and various consequential provisions;

(b) section 47: power of High Court in proceedings relating to estates of deceased persons and trusts to make judgments binding on persons who are not parties;

(c) section 51: amending the jurisdiction of county courts and district probate registrars in probate proceedings, and

(d) section 55: power of county courts to grant relief from forfeiture of a lease for non-payment of rent.
