The Secretary of State, in exercise of the powers conferred on him by section 33(2) and (3) of the Legal Aid (Scotland) Act 1986(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:
1. These Regulations may be cited as the Advice and Assistance (Scotland) Amendment (No.2) Regulations 1987 and shall come into force on 1st September 1987.
2. In these Regulations, "the principal Regulations" means the Advice and Assistance (Scotland) Regulations 1987(2).
3. In sub-paragraph (c) in Part I of Schedule 3 to the principal Regulations, for the words from "Schedule 1" to "Schedule 2 to" there shall be substituted "regulation 11(3) of, and Schedule I to," and at the end of sub-paragraph (c) there shall be added the words "assubstituted by regulation 4 of, and Schedule 2 to, the Criminal Legal Aid (Scotland) (Fees) Amendment (No. 2) Regulations 1987(3)".

These Regulations amend the provisions of the Advice and Assistance (Scotland) Regulations 1987 by bringing up to date a reference in them to the Criminal Legal Aid (Scotland) (Fees) Regulations 1987 (S.I. 1987/365), which are amended by the Criminal Legal Aid (Scotland) (Fees) Amendment (No. 2) Regulations 1987. The effect is to increase certain of the fees for assistance by way of representation in line with increases made in the fees for criminal legal aid.
