Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972(1) and has been approved by a resolution of each House of Parliament:
Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:-
1. This Order may be cited as the European Communities (Definition of Treaties) (International Convention on the Harmonised Commodity Description and Coding System) Order 1987. It shall come into force in respect of each treaty specified in the Schedule to this Order on the date on which the treaty enters into force for the United Kingdom. These dates will be notified in the London, Edinburgh and Belfast Gazettes.
2. The treaties specified in the Schedule to this Order are to be regarded as Community Treaties as defined in section 1(2) of the European Communities Act 1972.

1. International Convention on the Harmonised Commodity Description and Coding System signed at Brussels on 10th June 1985 (Cmnd. 9666).
2. Protocol of Amendment to the International Convention on the Harmonised Commodity Description and Coding System opened for signature on 24th June 1986 (Cm. 109).

This Order declares the International Convention on the Harmonised Commodity Description and Coding System, together with its associated Protocol of Amendment, to be Community Treaties as defined in section 1(2) of the European Communities Act 1972. The Convention is intended to modernise and replace, as the basis for customs tariff and statistical nomenclatures, the Convention on Nomenclature signed in Brussels on 15th December 1950 (Cmnd. 1070). The Protocol is concerned with the date of entry into force of the Convention.
The principal effect of declaring the Convention and Protocol to be Community Treaties as so defined is to bring into play, in relation to them, the provisions of section 2 of the European Communities Act 1972 which provides for the implementation of Treaties so specified.
