Present,

The Queen`s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 3 of the Genocide Act 1969(1), sections 2, 17 and 21 of the Extradition Act 1870(2), and section 17 of the Fugitive Offenders Act 1967(3), or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1. This Order may be cited as the Genocide (Anguilla) Order 1987 and shall come into force on 17th April 1987.

2. Section 1 of the Genocide Act 1969, modified and adapted as in the Schedule to this Order, and section 4 of, and the Schedule to, that Act shall extend to Anguilla.

3. The Extradition (Genocide) Order 1970(4) is amended by the insertion of Anguilla in Schedule 3 thereto (British possessions to which the application of the Genocide Convention is extended).

4. The Fugitive Offenders (Genocide) Order 1970(5) is amended by the insertion of Anguilla in the Schedule thereto (countries mentioned in Article 3 of the Order).

Article 2

SCHEDULESECTION 1 OF THE GENOCIDE ACT 1969 AS EXTENDED TO ANGUILLA

1.-(1) A person commits an offence of genocide if he commits any act falling within the definition of "genocide" in Article II of the Genocide Convention as set out in the Schedule to this Act.

(2) A person guilty of an offence of genocide shall on conviction on indictment -

(a)if the offence consists of the killing of any person, be sentenced to imprisonment for life;

(b)in any other case, be liable to imprisonment for a term not exceeding fourteen years.

(3) Proceedings for an offence of genocide shall not be instituted in Anguilla except by or with the consent of the person for the time being performing the functions of Attorney-General of Anguilla.

Explanatory Note

(This note is not part of the Order)

This Order extends to Anguilla, with adaptations and modifications, certain provisions of the Genocide Act 1969 (which gave effect to the Genocide Convention). It also extends to Anguilla the amendments made by the Genocide Act 1969 to the Extradition Acts 1870 to 1935 and the Fugitive Offenders Act 1967.
