The Silloth (Pilotage) Harbour Revision Order 1988

The Secretary of State for Transport in exercise of the powers conferred by section 14 of the Harbours Act 1964(1) and now vested in him(2) and of all other powers enabling him in that behalf and on the application of Associated British Ports in accordance with section 7(5) of the Pilotage Act 1987(3) hereby makes the following Order:

Citation and commencement

1. This Order may be cited as the Silloth (Pilotage) Harbour Revision Order 1988 and shall come into force on 1st October 1988.

Interpretation

2. In this Order -

"the existing area of jurisdiction" means the limits of the dock undertaking of Associated British Ports at Silloth, as described in section XL1 of the Carlisle and Silloth Bay Railway and Dock Act 1855(4), together with the limits within which the harbour master exercises authority, as described in section XLV1 of the said Act;

"the signed plan" means the plan signed in triplicate by an Under Secretary in the Department of Transport, two copies of which have been deposited at that Department and one copy of which has been deposited at the office of the Dock Master of Associated British Ports at Silloth situated at Dock Office, Silloth, Cumbria CA5 4JQ.

Extension of limits of jurisdiction for purposes of pilotage

3. The limits within which Associated British Ports shall have jurisdiction for the purposes of pilotage under Part I of the Pilotage Act 1987 shall include (in addition to the existing area of jurisidiction) the area coloured pink on the signed plan, being so much of the Solway Firth as is bounded on the seaward side by an imaginary line commencing at the level of high water at Grune Point in the County of Cumbria, (position latitude 54°54.00'N, longitude 03°20.20'W) extending thence due west-south-west to Southerness Point in the Region of Dumfries and Galloway, (position latitude 54°52.30'N, longitude 03°35.65'W), thence due south (true) to latitude 54°43.67'N and thence due east (true) to a point at the level of high water on the coastline of the County of Cumbria north-east of Maryport (position latitude 54°43.67'N, longitude 03°29.35'W) and on the landward side by an imaginary line drawn below the coastline of the County of Cumbria along the level of high water between the said Grune Point and the said point north-east of Maryport.

Explanatory Note

(This note is not part of the Order)

By virtue of section 7(5) of the Pilotage Act 1987 a direction given by a harbour authority for the purpose of making pilotage compulsory for ships navigating in a specified area shall not apply to any area which is outside the Authority's harbour unless the limits of jurisidiction of the authority for pilotage purposes have been extended to cover that area.

This Order accordingly extends the limits of jurisdiction of Associated British Ports, as Harbour authority for Silloth, for pilotage purposes under Part I of the Pilotage Act 1987 so as to include an area outside the harbour in respect of which the Authority considers that Pilotage should be compulsory.

The applicant for this Order is Associated British Ports.
