Coming into force
20th February 1988
The Secretary of State for Social Services in exercise of powers conferred by sections 84(1) and 89(1) of the Social Security Act 1986(1) and of all other powers enabling him in that behalf, by this instrument, which contains only provisions consequential on sections 20 to 22 of that Act and Regulations made under those sections in their application to family credit and is made before the end of a period of 12 months from the commencement of those sections, makes the following regulations:
1. These Regulations may be cited as the Family Credit (Transitional) Amendment Regulations 1988 and shall come into force on 20th February 1988.
2. In regulations 6(1) and 7 of the Family Credit (Transitional) Regulations 1987(2) (determination of circumstances where family credit replaces family income supplement or is claimed before 11th April 1988) for the words "section 20(5)" wherever they occur there shall be substituted the words "sections 20(5) and 22(6)".
Signed by authority of the Secretary of State for Social Services
Michael Portillo
Parliamentary Under-Secretary of State,
Department of Health and Social Security
17th February 1988
(This note is not part of the Regulations)
These Regulations amend the Family Credit (Transitional) Regulations 1987 to make provision for a claimant's capital to be determined on the assumption that it is the same on 11th April 1988 as it was at the date of his family income supplement or family credit claim.
The Regulations contain only provisions consequential on sections 20 to 22 of the Social Security Act 1986 and Regulations made under those sections in their application to family credit and are made before the expiry of 12 months from the commencement of those sections. Accordingly, the Regulations are exempt, by section 61(5) of that Act, from reference to the Social Security Advisory Committee and have not been so referred.
1986 c. 50; section 84(1) is cited because of thre meaning assigned to the word "regulations".
