The Housing and Planning Act 1986 (Commencement No. 11) Order 1988

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by section 57(2) of the Housing and Planning Act 1986(1), and of all other powers enabling them in that behalf, hereby make the following Order:

1. This Order may be cited as the Housing and Planning Act 1986 (Commencement No. 11) Order 1988.

2. Section 6 (consultation before disposal to private sector landlord) of the Housing and Planning Act 1986 shall come into force on 11th March 1988.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 11th March 1988 section 6 of and Schedule 1 to the Housing and Planning Act 1986, which insert a new section 106A and Schedule 3A in the Housing Act 1985 (c. 68).

The new provisions require a local authority proposing to dispose of dwellings subject to secure tenancies (within Part IV of the 1985 Act), and the Secretary of State when considering whether to consent to such a disposal (under sections 32 or 43 of that Act), to have regard to the views of tenants liable as a result of the disposal to cease to be secure tenants. The Secretary of State's consent is to be withheld if it appears to him that a majority of the tenants concerned are opposed to the disposal.
