The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 41(2D) and 64(1D) of and Schedule 20 to the Social Security Act 1975(1) and of all other powers enabling him in that behalf, the Social Security Advisory Committee having agreed that the proposals to make these Regulations should not be referred to it(2), hereby makes the following Regulations:

Citation and commencement

1. These Regulations may be cited as the Social Security Benefit (Dependency) Amendment (No. 2) Regulations 1988 and shall come into force on 11th April 1988.

Meaning of "week" for the purpose of calculating earnings

2. After regulation 5 of the Social Security Benefit (Dependency) Regulations 1977(2) there shall be inserted the following regulation-

"Meaning of "week" for the purpose of calculating earnings

6. For the purposes of sections 41 and 64 of the Social Security Act 1975 (beneficiary's dependent children) "week" in the expression "has earnings in any week" means a period of 7 days beginning with midnight between Sunday and Monday."

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which come into force on 11th April 1988, provide for the purpose of determining the level of earnings of a beneficiary's partner in any week, that "week" means a period of 7 days commencing at midnight between Sunday and Monday. A similar provision was previously included at regulation 15(3) of the Social Security (Claims and Payments) Regulations 1979 (now revoked).

1975 c. 14; sections 41(2D) and 64(1D) were inserted by the Health and Social Security Act 1984 (c. 48), Schedule 5, paragraphs 3(c) and 4; section 64(1D) ceases to have effect for certain purposes as from 6.4.87 - see Social Security Act 1986 (c. 50) Schedule 3, paragraph 4 and S.I. 1987/354, Schedule 1; Schedule 20 is cited because of the meaning ascribed to the words "Prescribed" and "Regulations".
