REGISTRATION OF BIRTHS, DEATHS, MARRIAGES, ETC. ENGLAND AND WALES

The Registrar General, in exercise of the powers conferred on her by sections 14A, 39 and 41 of the Births and Deaths Registration Act 1953(1), as extended by section 2(2) of the Welsh Language Act 1967(2), and of all other powers enabling her in that behalf, with the approval of the Secretary of State for Wales(3), hereby makes the following Regulations:-
1.-(1) These Regulations may be cited as the Registration of Births and Deaths (Welsh Language) (Amendment) Regulations 1988 and shall come into force on 4th April 1988.
(2) In these Regulations "the main Regulations" means the Registration of Births and Deaths (Welsh Language) Regulations 1987(4).
2. After regulation 4 of the main Regulations there shall be inserted the following regulation:-
4A. Where under section 14A of the Act the Registrar General authorises the relevant registrar to re-register a birth that occurred in Wales, then provided that:-
(a)a qualified informant elects for the particulars required by regulation 26A of the principal Regulations(5) to be entered in Welsh as well as English, and
(b)the informant gives the particulars referred to in regulation 26A(a) of the principal Regulations in Welsh personally to the relevant registrar, and
(c)the relevant registrar can understand and write Welsh,
the relevant registrar shall:-
(i)enter the particulars referred to in regulation 26A(a) in Welsh as well as English;
(ii)enter particulars of the informant in spaces 11 to 13 in Welsh as well as English;
(iii)call upon the informant to verify the particulars entered and to sign the entry in space 14;
(iv)enter the words required by regulation 26A(b) of the principal Regulations and regulation 3 of these Regulations (those words being entered in spaces 11 to 14 as required by regulation 26A(b) of the principal Regulations in addition to any particulars entered in those spaces by virtue of paragraphs (ii) and (iii) of this regulation);
(v)draw a line through any unused space;
(vi)enter in space 15 the date on which the entry is made and sign the entry in space 16, adding his official description.".
3. In Schedule 3 of the main Regulations after the entry relating to regulation 23(b) there shall be inserted the following entries in columns (1), (2) and (3) respectively:-

These Regulations amend the Registration of Births and Deaths (Welsh Language) Regulations 1987 (the main Regulations).
Regulation 2 inserts regulation 4A in the main Regulations to provide a procedure for the entering in Welsh as well as in English of particulars of a birth in Wales which is re-registered following a declaration of parentage or legitimacy under section 56 of the Family Law Act 1986 (c. 55).
Regulation 3 makes consequential amendments to Schedule 3 of the main Regulations (Welsh version of required form of words).

1953 c. 20; section 14A was inserted by section 26 of the Family Law Reform Act 1987 (c. 42); see definitions of "prescribed" and "the Minister" in section 41.
The approval of the Secretary of State is required to the exercise of the power conferred by section 14A of the Births and Deaths Registration Act 1953, see section 39 of that Act, and article 2 of the Secretary of State for Social Services Order (S.I. 1968/1699) which transferred all functions of the Minister of Health to the Secretary of State.
