The Lord Chancellor, in exercise of the powers conferred on him by section 81A of the Solicitors Act 1974(1) and with the concurrence of the Lord Chief Justice and the Master of the Rolls, hereby makes the following Order:
1.-(1) This Order may be cited as the Commissioners for Oaths (Fees) Order 1988 and shall come into force on 23rd May 1988.
(2) In this Order "commissioners for oaths" includes a solicitor exercising the powers of a commissioner for oaths under section 81 of the Solicitors Act 1974.
2.-(1) Subject to paragraph (2), the following fees shall be charged by commissioners for oaths:-

For taking an affidavit, declaration or affirmation, for each person making the same ... ... ... ... | 3.50 |
And in addition, for each exhibit therein referred to and required to be marked or for each schedule required to be marked ... ... ... ... | 1.00 |
(2) Where value added tax is payable by a commissioner for oaths supplying a service for which a fee is prescribed under paragraph (1), he shall charge for that service a fee of such an amount as, with the addition of the tax, is equal to the amount so prescribed.
3. The Commissioners for Oaths (Fees) Order 1984(2) is hereby revoked, save as to any fee due or payable before the coming into force of this Order.

This Order increases the fees chargeable by commissioners for oaths and practising solicitors for taking affidavits and similar declarations from £3.00 to £3.50 and for marking exhibits from 75p to £1.00. The increased amounts include value added tax where payable.
