The Registration of Title Order 1989

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 120(1) and (6) of the Land Registration Act 1925(1) and sections 80(2) and 90 of the London Government Act 1963(2), is pleased, by and with the advice of Her Privy Council, to order and declare, and it is hereby ordered and declared, as follows:

1. This Order may be cited as the Registration of Title Order 1989 and shall come into force on 1st January 1990.

2.-(1) In addition to the areas mentioned in column 2 of the Schedule to the Registration of Title (No. 2) Order 1988(3) (being the areas in England and Wales in which registration of title to land is already compulsory on sale) registration of title shall be compulsory on sale,

(a)on and after 1st January 1990 in the districts of North Shropshire, Oswestry, Shrewsbury and Atcham, South Shropshire, and

(b)on and after 1st April 1990 in the districts of Kennet, North Dorset, North Wiltshire, Purbeck, Salisbury, West Dorset, and

(c)on and after 1st December 1990 in the districts of Babergh, Castle Point, Forest Heath, Leominster, Maldon, Malvern Hills, Mid Suffolk, Rochford, St. Edmundsbury, South Herefordshire, Suffolk Coastal, Tendring, Wychavon and Wyre Forest.

(2) Accordingly, on and after 1st December 1990, registration of title to land shall be compulsory on sale in the areas mentioned in column 2 of the Schedule to this Order.

(3) As from 1st December 1990 the Registration of Title (No. 2) Order 1988 shall cease to have effect.

Explanatory Note

(This note is not part of the Order)

This Order extends the system of compulsory registration of title on sale of land to the districts mentioned in article 2(1)(a) with effect from 1st January 1990; to those mentioned in article 2(1)(b) with effect from 1st April 1990 and, to those mentioned in article 2(1)(c) with effect from 1st December 1990. The Order completes the extension of compulsory registration to the whole of England and Wales from the latter date.
