The Submarine Pipe-lines (Designated Owners) (No. 22) Order 1989

The Secretary of State, in exercise of the powers conferred on him by section 33(2) and (3) of the Petroleum and Submarine Pipe-lines Act 1975(1) and of all other powers enabling him in that behalf, and after giving those persons affected an opportunity of being heard with respect to the matter, hereby makes the following Order:-�

1. This Order may be cited as the Submarine Pipe-lines (Designated Owners) (No. 22) Order 1989, and shall come into force on 11th September 1989.

2. In this Order-�

"the Act" means the Petroleum and Submarine Pipe-lines Act 1975;

"the Clyde Platform" means the offshore installation known as the Clyde platform, which is situated above the Clyde oilfield, east of the Fife Region of Scotland;

"Fulmar A" means the offshore installation known as the Fulmar A platform, which is situated above the Fulmar oilfield, east of the Fife Region of Scotland;

"the pipe-lines" means the two 16 inch nominal diameter pipes, brought into use on 17th March 1987, which lie between the Clyde platform and Fulmar A and the apparatus and works associated therewith;

"the platform apparatus" means all of the apparatus and works of a kind specified in paragraph (a), (aa), (b), (c), (d), (e) or (f) of section 33(1) of the Act(2) which are part of each of the pipe-lines and attached to Fulmar A; and

"the riser" means that section of each of the pipe-lines which connects Fulmar A to that section of the pipe-line which lies in, or in close proximity to, the sea-bed and extends outwards from Fulmar A.

3. For the purposes of Part III of the Act, except section 33(2), in respect of each of the pipe-lines, the platform apparatus and the riser shall together be treated as a pipe-line and the remainder of each of the pipe-lines shall be treated as a separate pipe-line.

4. For the purposes of Part III of the Act, the persons specified in Part I of the Schedule hereto are hereby designated as the owners of the platform apparatus and the riser comprised in each of the pipe-lines, and the persons specified in Part II of the Schedule are hereby designated as the owners of the remainder of each of the pipe-lines.

Amoco (U.K.) Exploration Company Ltd., whose principal place of business in the United Kingdom is at Amoco House, West Gate, Ealing, London W5 1XL.

Esso Exploration and Production UK Ltd., whose registered office is at Esso House, Victoria Street, London SW1E 5JW.

Shell U.K. Ltd., whose registered office is at Shell-Mex House, Strand, London WC2R 0DX.

Texas Eastern North Sea, Inc., whose principal place of business in the United Kingdom is at Berkeley Square House, Berkeley Square, London W1X 5LE.

PART IIdesignated owners of remainder of pipe-lines

Britoil p.l.c., whose registered office is at 301 St. Vincent Street, Glasgow G2 5DD.

Esso Exploration and Production UK Ltd., whose registered office is at Esso House, Victoria Street, London SW1E 5JW.

Shell U.K. Ltd., whose registered office is at Shell-Mex House, Strand, London WC2R 0DX.

Explanatory Note

(This note is not part of the Order)

This Order designates owners of two pipe-lines lying between offshore installations above the Clyde and Fulmar oilfields, situated east of the coast of Fife. The companies listed in Part I of the Schedule are designated as owners of the apparatus and works and the riser which in each case form part of each of the pipe-lines and which are installed on or beneath the platform, and the companies listed in Part II of the Schedule are designated as owners of that part of the remainder of each of the pipe-lines which lie in controlled waters, that is the territorial sea and areas designated under the Continental Shelf Act 1964 (c. 29).
