The Adoption Allowance Schemes Order 1989

The Secretary of State in exercise of the powers conferred by section 57(8) of the Adoption Act 1976(1) and all other powers enabling him in that behalf and having published a report(2) under section 57(6) of that Act, hereby makes the following Order, a draft of which has been laid before and approved by resolution of each House of Parliament:

Citation and Commencement

1. This Order may be cited as the Adoption Allowance Schemes Order 1989 and shall come into force on 14th February 1989.

Repeals

2. Section 57(7) of the Adoption Act 1976 (expiry after seven years of section 57(4) of the 1976 Act which provides for adoption allowance schemes) is hereby repealed.

Explanatory Note

(This note is not part of the Order)

Section 57(4) of the Adoption Act 1976 disapplies the prohibition of payments in connection with adoption arrangements where a scheme for payment has been submitted to the Secretary of State by an adoption agency and approved. Section 57(7) provides for subsection (4) to expire on the seventh anniversary of the date on which section 32 of the Children Act 1975 came into force (15th February 1982) unless the Secretary of State repeals subsection (7) prior to the said anniversary.

The power to repeal subsection (7) is contained in section 57(8) and is exercisable only in connection with the publication of a report under section 57(6) on the operation of the said schemes. Such a report has been published under the title "Adoption Allowances in England and Wales: The Early Years" and can be obtained from HMSO Publications Centre, P.O. Box 276, London, SW8 5DT.
