The Carmarthen-Llandeilo Trunk Road A40 (Llandeilo Northern By-pass) Order 1989

Coming into force

31st March 1989

The Secretary of State for Wales makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and of all other enabling powers:-�

1. The new highways which the Secretary of State proposes to construct along the routes described in Schedule 1 to this Order shall become trunk roads as from the date when this Order comes into force.

2. The centre line of the new trunk roads are indicated by a heavy black line on the deposited plan.

3. The lengths of trunk road described in Schedule 2 to this Order, and shown by broad striped hatching on the deposited plan shall cease to be trunk roads, and shall be classified as unclassified (between points "A" and "B" on the deposited plan) and classified road (between points "C" and "D" on the deposited plan) as from the date on which the Secretary of State notifies the County Council of Dyfed that the new trunk roads are open for through traffic.

4. In this Order:-�

All measurements of distance are measured along the route of the relevant highway.

(i)"the deposited plan" means the plan numbered HA10/2 W064 marked "The Carmarthen-Llandeilo Trunk Road A40 (Llandeilo Northern By-pass) Order 1989", signed by authority of the Secretary of State, and deposited at the Welsh Office Repository, Curran Embankment, Cardiff.

(ii)"the new trunk roads" means the highways mentioned in article 1 of this Order.

(iii)"the trunk road" means the Carmarthen-Llandeilo Trunk Road (A40).

(iv)"classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads, but is classified for the purpose of every enactment or instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads.

5. The Llandeilo-Carmarthen Trunk road (Penrock Bends Diversion) Order 1979(2) is hereby revoked except for that length of new Trunk Road mentioned in article 1 of that Order and described in Schedule 1 to that Order, starting at a point about 140 metres east of Woodlands House and extending in a generally easterly direction for about 390 metres to a point 200 metres south-east of the east side of King's Lodge.

6. This Order shall come into force on 31st March 1989 and may be cited as the Carmarthen-Llandeilo Trunk Road A40 (Llandeilo Northern By-pass) Order 1989.

SCHEDULE 1ROUTES OF THE NEW TRUNK ROADS

The routes of the new trunk roads are routes at Llandeilo in the County of Dyfed as follows:-�

A route about 520 metres in length starting at a point about 200 metres south-east of the east side of King's Lodge and going in a south-easterly direction to a point 40 metres south-east of the east side of Penrock.

A route 1,530 metres in length starting at a point about 125 metres west of the west side of Llwynhelig Lodge and going in an easterly direction to a point about 90 metres south-west of St David's Church on the existing A40 trunk road.

SCHEDULE 2LENGTHS OF THE TRUNK ROAD CEASING TO BE TRUNK ROAD

The lengths of the trunk road ceasing to be trunk road at Llandeilo in the County of Dyfed are as follows:-�

A length approximately 400 metres commencing at a point 59 metres west of the west side of Llwynhelig Lodge (marked "A" on the deposited plan) and extending in a south-easterly direction to a point 196 metres west of the west corner of the White Hart Public House (marked "B" on the deposited plan).

A length approximately 1,200 metres commencing at a point 142 metres west of the west corner of the White Hart Public House (marked "C" on the deposited plan) and extending in a southerly then north-easterly direction to the junction of the trunk road at New Road with Rhosmaen Street (marked "D" on the deposited plan).

Explanatory Note

(This note is not part of the Order)

This Order revokes an Order made under Section 7 of the Highways Act 1959, which provided for a diversion of the Llandeilo-Carmarthen Trunk Road at Llandyfeisant in the County of Dyfed.

In its place, the Order lays down the centre lines of a proposed trunk road which, if constructed, would allow for a northern by-pass of Llandeilo. The Order also provides for the de-trunking of the superseded trunk road.
