This statutory instrument has been made to correct an error in S.I. 1989/438 and is to be issued free of charge to all known recipients of that instrument.

The Secretary of State for the Environment as respects England, and the Secretary of State for Wales as respects Wales, in exercise of the powers conferred on them by paragraph 27 of Schedule 4 to the Local Government Finance Act 1988(1), and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Community Charges (Administration and Enforcement) (Amendment) Regulations 1989 and shall come into force on 19th May 1989.
2. For regulation 51(1)(b) of the Community Charges (Administration and Enforcement) Regulations 1989(2) there is substituted-�
"(b)in supplying information in purported compliance with that regulation he makes a statement which he knows to be false in a material particular or recklessly makes a statement which is false in a material particular.".

These Regulations correct an error in the Community Charges (Administration and Enforcement) Regulations 1989. They substitute a new regulation 51(1)(b) in those Regulations so that that provision accords with paragraph 27(1)(b) of Schedule 4 to the Local Government Finance Act 1988. The result is that a person commits an offence by making a statement which is false in a material particular in purported compliance with a request under regulation 31(2)(b) of those Regulations only if he does so knowingly or recklessly.
