In exercise of the powers conferred upon me by section 26 of the Fire Services Act 1947(1) I hereby, with the approval of the Treasury(2) and after consultation with the Central Fire Brigades Advisory Council and the Scottish Central Fire Brigades Advisory Council, make the following Order:

1.-(1) This Order may be cited as the Firemen's Pension Scheme (Amendment) Order 1989.

(2) This Order shall come into force on 15th June 1989 and shall have effect as from 16th March 1988.

2.-(1) The Firemen's Pension Scheme 1973, set out in Appendix 2 to the Firemen's Pension Scheme Order 1973(3) shall be amended in accordance with the following provisions of this article.

(2) In Part I of Schedule 3-�

(a)in paragraph 1(2), for "12.5%" there shall be substituted "18.75%", and

(b)in paragraph 1(3), for "4 or more" there shall be substituted "3 or more".

Explanatory Note

(This note is not part of the Order)

This Order, which comes into force on 15th June 1989, amends the Firemen's Pension Scheme Order 1973 with effect from 16th March 1988 (retrospection is authorised by sections 12 and 16 of the Superannuation Act 1972).

Article 2 amends Schedule 3 of the Scheme set out in Appendix 2 to the Order of 1973 by increasing from 12.5% to 18.75% the maximum rate at which a child's ordinary allowance is payable in respect of the death of a regular fireman. The total amount payable by way of children's ordinary allowances in respect of the death remains 37.5% of the deceased's pension or notional pension (or, where appropriate, of the alternative amount specified in the Schedule); consequently, where 3 or more such allowances are payable, the rate is reduced to provide an equal share of that total amount (the number was previously 4 or more).
