FEES AND CHARGES

The European Economic Interest Grouping (Fees) Regulations 1989

The Secretary of State for Trade and Industry, with the consent of the Treasury, in exercise of the powers conferred on him by section 56(1) and (2) of the Finance Act 1973(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:-�

1. These Regulations may be cited as the European Economic Interest Grouping (Fees) Regulations 1989 and shall come into force on 1st July 1989.

2. In these Regulations, unless the context otherwise requires -�

"the Act" means the Companies Act 1985(2) (any reference to a numbered section being to a section of that Act);

"the EC Regulation" means Council Regulation (EEC) No. 2137/85 of 25th July 1985 on the European Economic Interest Grouping (EEIG)(3);

"EEIG" means a European Economic Interest Grouping formed in pursuance of article 1 of the EC Regulation;

"the principal Regulations" means the European Economic Interest Grouping Regulations 1989(4); and

"the relevant Community obligations" means the Community obligations of the United Kingdom under article 39 of the EC Regulation.

3. The fees payable in connection with the services and facilities provided by the Department of Trade and Industry in pursuance of the relevant Community obligations relating to the matters set out in the first column of the Schedule to these Regulations, implemented in part by the principal Regulations, shall be the fees payable to the registrar of companies set out in the second column of that Schedule.

4. All fees received under these Regulations shall be paid into the Consolidated Fund.

SCHEDULEFEES TO BE PAID TO THE REGISTRAR OF COMPANIES

1.For registration of an EEIG whose official address is in Great Britain under regulation 9 of the principal Regulations ... ... ... ...The same amount as is payable for registration of a company on its formation under the Act(5)
2.For inspection of documents and particulars under regulation 14 of the principal Regulations except the index kept by the registrar of companies under section 714(1) as applied by regulation 18 of, and Schedule 4 to, the principal Regulations: for each inspection of documents and particulars relating to one EEIG ... ... ... ...The same amount as is payable for inspection of documents under section 709(1)(5)
3.For delivering or sending by post by the registrar of companies of a copy or extract of any document or particulars, or any part thereof, delivered to the registrar and kept by him by virtue of regulation 14 of the principal Regulations: for each copy or extract ... ... ... ...£4.00

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe the fees payable in connection with services and facilities provided by the Department of Trade and Industry in pursuance of Community obligations of the United Kingdom under Council Regulation (EEC) No. 2137/85, implemented in part by the European Economic Interest Grouping Regulations 1989. The fees are as follows:-�

1. For registration of a European Economic Interest Grouping (EEIG) whose official address is in Great Britain, the amount of the fee is the same as is payable for registration of a company on its formation (£50.00 under the Companies (Fees) Regulations 1988).

2 For inspection of documents and particulars relating to an EEIG, the amount of the fee is the same as is payable for inspection of documents under section 709(1) of the Companies Act 1985 (£2.50 under the Companies (Fees) Regulations 1988).

3. For delivering or sending by post by the registrar of companies of a copy or extract of any document or particulars delivered to and kept by him under the European Economic Interest Grouping Regulations 1989, the amount of the fee is £4.00.
