The Secretary of State for Wales, in exercise of the powers conferred on him by sections 54(7), 56(6), 56B(2), 271, 277A(1) and (8), 287(1) and (2), 290(1) of and paragraphs 1 and 2 of Schedule 11 and Part VI of Schedule 21 to, the Town and Country Planning Act 1971(2), as extended by section 2(2) of the Welsh Language Act 1967(3), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement, application and interpretation

1.-(1) These Regulations may be cited as the Town and Country Planning (Listed Buildings in Wales and Buildings in Conservation Areas in Wales) (Welsh Forms) Regulations 1990 and shall come into force on 27th June 1990.

(2) These Regulations apply only in respect of listed buildings(4) in Wales and buildings in conservation areas in Wales.

(3) In these Regulations "the principal Regulations" means the Town and Country Planning (Listed Buildings and Buildings in Conservation Areas) Regulations 1987(5).

Notification to applicant

2.-(1) The form set out in Part I of Schedule 1 to these Regulations is hereby prescribed as the version in Welsh which may be used instead of the form in Part I of Schedule 1 to the principal Regulations (notification to be sent to applicant on receipt of application for listed building consent, for conservation area consent or to vary or discharge conditions attached to listed building consent or conservation area consent).

(2) The form set out in Part II of Schedule 1 to these Regulations is hereby prescribed as the version in Welsh which may be used instead of the form in Part II of Schedule 1 to the principal Regulations (notification to be sent to applicant on refusal of listed building consent or conservation area consent or grant of consent subject to conditions).

(3) The form set out in Part III of Schedule 1 to these Regulations is hereby prescribed as the version in Welsh which may be used instead of the form in Part III of Schedule 1 to the principal Regulations (notification to be sent to applicant on refusal to vary or discharge conditions attached to listed building consent or conservation area consent, or on the addition of new conditions consequential upon variation or discharge).

Certificates and notices

3.-(1) The forms set out in Part I of Schedule 2 to these Regulations are hereby prescribed as the versions in Welsh which may be used instead of the forms in Part I of Schedule 2 to the principal Regulations (certificates to accompany applications and appeals).

(2) The forms set out in Part II of Schedule 2 to these Regulations are hereby prescribed as the versions in Welsh which may be used instead of the forms in Part II of Schedule 2 to the principal Regulations (notice of application for listed building consent, conservation area consent or for variation or discharge of conditions, for service on individuals and notice for publication in local newspapers).

(3) The forms set out in Part III of Schedule 2 to these Regulations are hereby prescribed as the versions in Welsh which may be used instead of the forms in Part III of Schedule 2 to the principal Regulations (notice of appeal for service on individuals and notice of appeal for publication in local newspapers).

Notice of listing and of exclusion from listing

4. The forms set out in Schedule 3 to these Regulations are hereby prescribed as the versions in Welsh which may be used instead of the forms in Schedule 4 to the principal Regulations (form of notice that a building has become listed or has ceased to be listed).

(1) Os tramgwyddir y ceisydd gan benderfyniad yr awdurdod cynllunio lleol i wrthod caniatâd adeilad rhestredig neu ganiatâd ardal gadwraeth am y gwaith arfaethedig, neu i roi caniatâd yn ddarostyngedig i amodau, gall apelio at Ysgrifennydd Gwladol Cymru yn unol â pharagraff 8 Atodiad 11 Deddf Cynllunio Gwlad a Thref 1971 o fewn chwe mis ar ôl cael yr hysbysiad hwn. (Rhaid gwneud apelau ar ffurflen y gellir ei chael oddi wrth y Swyddfa Gymreig). Mae gan yr Ysgrifennydd Gwladol bŵer i ganiatáu cyfnod hwy ar gyfer rhoi hysbysiad apêl ond fel arfer ni fydd yn barod i ymarfer y pŵer hwn oni bai bod amgylchiadau arbennig sy'n esgusodi'r oedi wrth roi hysbysiad apêl.

(2) Os gwrthodir caniatâd adeilad rhestredig neu ganiatâd ardal gadwraeth, neu os rhoddir hwy yn ddarostynedig i amodau, naill ai gan yr awdurdod cynllunio lleol neu gan Ysgrifennydd Gwladol Cymru, ac os yw perchennog y tir yn honni nad oes modd yn awr ddefnyddio'r tir er budd rhesymol yn ei gyflwr presennol ac na ellir peri y gellir ei ddefnyddio er budd rhesymol trwy gyflawni unrhyw weithiau sydd wedi'u caniatáu neu y byddid wedi'u caniatáu, gall gyflwyno i gyngor y dosbarth y lleolir y tir ynddo hysbysiad prynu sy'n ei gwneud yn ofynnol i'r cyngor hwnnw brynu ei ddiddordeb yn y tir yn unol â darpariaethau adran 190 Deddf Cynllunio Gwlad a Thref 1971.

(3) O dan rai amgylchiadau gellir gwneud cais yn erbyn yr awdurdod cynllunio lleol am iawndal lle gwrthodir caniatâd neu lle y'i rhoddir yn ddarostyngedig i amodau gan yr Ysgrifennydd Gwladol ar apêl neu pan gyfeirir cais ato. Nodir yr amgylchiadau lle mae iawndal o'r fath yn daladwy yn adran 171 Deddf Cynllunio Gwlad a Thref 1971.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe Welsh versions of-

(a)forms of notification to be sent to the applicant in connection with an application for listed building consent, conservation area consent or for the variation or discharge of conditions subject to which listed building consent or conservation area consent has been granted (regulation 2 and Schedule 1); and

(b)forms of certificate and notice to be used in connection with the applications described in paragraph (a) above and appeals to the Secretary of State pursuant to paragraph 8 or paragraph 9 of Schedule 11 to the Town and Country Planning Act 1971 (regulation 3 and Schedule 2); and

(c)forms of notification to be used to inform an owner or occupier that a building has become listed or has ceased to be listed (regulation 4 and Schedule 3).

The Welsh versions prescribed by these Regulations may be used only in respect of listed buildings in Wales and buildings in conservation areas in Wales.
