The Secretary of State for Wales, in exercise of the powers conferred on him by section 2(9) and 15(5) of the Local Government Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1. This order may be cited as the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) (Amendment) Order 1990 and shall come into force on 19th August 1990.
2. In article 2 of the Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1988(2), after paragraph (2), there shall be inserted-
"(3) References in this Order to section 2(2) of the Act(3) are references to that section as amended from time to time by the addition of paragraphs by order made under section 2(3) of the Act".

The Local Government Act 1988 (Defined Activities) (Exemptions) (Wales) Order 1988 (S.I. 1988/1469) provides that an activity listed in section 2(2) of the Local Government Act 1988 shall not be treated as a defined activity for the purpose of that Act so long as specified conditions are fulfilled.
This Order amends that Order so as to extend its application to activities added to section 2(2) by order made under section 2(3).
