Whereas Yorkshire Water Services Limited holds an appointment under Chapter I of Part II of the Water Act 1989(1)as a water and sewerage undertaker, and Cambridge Water Company, East Surrey Water PLC and East Worcestershire Waterworks Company each hold an appointment under the same Chapter as a water undertaker ("the Companies"):
And whereas each company has, pursuant to section 162(6)(a) of that Act, submitted to the Secretary of State for his approval a Code of Practice(2)with respect to the exercise by the Companies of powers conferred by or by virtue of paragraph 4 of Schedule 19 to that Act ("the Codes of Practice"):
And whereas the Secretary of State considers it appropriate to approve the Codes of Practice for the purpose of promoting what appear to him to be desirable practices with regard to the exercise by the Companies of those powers:
Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 162(7) of the Water Act 1989, and after consulting all such persons as he considers it appropriate to consult, hereby makes the following Order:
1. This Order may be cited as the Cambridge, East Surrey, East Worcestershire and Yorkshire (Pipelaying and Other Works) (Codes of Practice) Order 1990.
2. The Codes of Practice prepared by the Companies and certified as such by the Secretary of State are hereby approved.
