The Secretary of State for Education and Science, in exercise of the powers conferred on him by section 231(2) to (5) of the Education Reform Act 1988(1) ("the Act") hereby makes the following Order:
1. This Order may be cited as the Education (Inner London Education Authority) (Transitional and Supplementary Provisions) (No. 3) Order 1990 and shall come into force on 1st September 1990.
2.-(1) Regulation 10 of the Education (Areas to which Pupils and Students Belong) Regulations 1989(2) shall be amended in accordance with the provisions of this article.
(2) In paragraph (2)(a) after the words "of another local education authority," there shall be added the words "subject to paragraph (4)".
(3) At the end there shall be added the following paragraphs-
"(4) A student who but for the abolition of the Inner London Education Authority ("ILEA")(3) would fall to be treated by virtue of paragraph (2)(a) as belonging to the area of that authority shall instead be treated as belonging to the area of the relevant successor authority.
(5) In paragraph (4) above the reference to the relevant successor authority is to the inner London council which on the abolition of the ILEA became by virtue of section 163 of the Education Reform Act 1988 the local education authority for the area in which the student was ordinarily resident immediately before moving as is mentioned in paragraph (2)(a).".
3. In paragraph (2) of article 2 of the Education (Inner London Education Authority) (Transitional and Supplementary Provisions) Order 1990(4) for the words "the Education (Mandatory Awards) Regulations 1989" there shall be substituted the words "the regulations for the time being in force made under the said section 1 and Schedule 1".

This Order amends the Education (Areas to which Pupils and Students Belong) Regulations 1989 in consequence of the abolition of the Inner London Education Authority ("ILEA").
Those Regulations determine the area to which a student belongs both for the purposes of recoupment between local education authorities and for the purposes of mandatory awards under the Education Act 1962 (c. 12). Under regulation 10 in its unamended form certain students were required to be treated as belonging to the area of the ILEA if ordinarily resident there at a particular time. Under the regulation as amended such persons are treated as belonging to the area of the inner London council in which they were ordinarily resident at that time.
A drafting amendment has been made to the Education (Inner London Education Authority) (Transitional and Supplementary Provisions) Order 1990.
S.I. 1989/2037, to which there are amendments not relevant to this Order.
The Inner London Education Authority was abolished on 1st April 1990 by section 162 of the Education Reform Act 1988 (c. 40)
