Whereas in pursuance of the requirements of section 40(3) of the Trade Marks Act 1938(1) the Secretary of State has, before making the following Rules under that Act, published notice of his intention to make such Rules and of the place where copies of the draft Rules might be obtained by advertising such notice in the Trade Marks Journal and the Official Journal (Patents) on 8th August 1990 and 15th August 1990, being the manner which he considered most expedient so as to enable persons affected to make representations to him before the Rules were finally settled:
Now, therefore, the Secretary of State, in exercise of the powers conferred by sections 40, 41 and 68(1) of the Trade Marks Act 1938 and now vested in him(2), of the power conferred on him by the Department of Trade and Industry (Fees) Order 1988(3), and of all other powers enabling him in that behalf, after consultation with the Council on Tribunals pursuant to section 10(1) of the Tribunals and Inquiries Act 1971(4) and with the sanction of the Treasury pursuant to the said section 41, hereby makes the following Rules:-
1.-(1) These Rules may be cited as the Trade Marks and Service Marks (Fees) Rules 1990 and shall come into force on 1st October 1990.
(2) The Trade Marks and Service Marks (Fees) Rules 1989(5) are hereby revoked.
2. These Rules shall be construed as one with the Trade Marks and Service Marks Rules 1986(6).
3. The fees to be paid in respect of any matters arising under the Trade Marks Act 1938 shall be those specified in the Schedule to these Rules; and in any case where a form specified in the Schedule as the corresponding form in relation to any matter is required by the Trade Marks and Service Marks Rules 1986 to be used, that form shall be accompained by the fee specified in respect of that matter.

The fee to be paid on any proceeding at the Manchester Branch and at the office of the Cutlers' Company shall be the same as for the similar proceeding at the Office.
For the purpose of these fees (except as specifically provided above) every mark of a series under section 21, or any preceding similar enactment, shall be deemed to be a mark separately registered.

These Rules revoke and replace the Trade Marks and Service Marks (Fees) Rules 1989 (the 1989 Rules) and prescribe, in respect of all applications to register a trade mark or service mark filed on or after the date of the coming into force of these Rules (1st October 1990), a composite fee of £160 for an application to register a mark and for the registration of the mark (whether or not accepted for registration). Under the 1989 Rules an application to register a mark was subject to an initial fee of £68, with a further fee of £95 on its acceptance for registration; the latter fee will continue to apply to applications to register made before 1st October 1990. All other fees remain unchanged.
Although the composite fee for registration prescribed under these Rules will result in a marginal reduction in the total fee (£163) payable under the 1989 Rules for an application to register a mark which proceeds to registration, it is estimated that its effect will be to generate additional revenue sufficient to cover the unit cost of the combined service; in the event that there is no change in demand trade mark revenue per annum would increase by 25.8%.
