In exercise of the powers conferred on the Secretary of State by section 8 of the Rent Act 1977(1) and paragraph 8 of Schedule 1 to the Housing Act 1988(2), the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:
1. These Regulations may be cited as the Assured and Protected Tenancies (Lettings to Students) (Amendment) Regulations 1990 and shall come into force on 1st October 1990.
2. The Assured and Protected Tenancies (Lettings to Students) Regulations 1988(3) shall be further amended in accordance with the following provisions of these Regulations.
3. For regulation 4A(4) there shall be substituted the following regulation-
"4A The following bodies of persons (whether corporate or unincorporated) are hereby specified as bodies for the purposes of paragraph 8 of Schedule 1 to the Housing Act 1988, that is to say-
(a)any housing association (as defined in section 1 of the Housing Associations Act 1985(5)) which is registered by the Housing Corporation or Housing for Wales in accordance with Part I of the Housing Associations Act 1985 and which is not listed in Schedule 1 to these Regulations; and
(b)a body listed in Schedule 2 to these Regulations.".
4. In Schedule 1 for each name specified in column (1) of the table below there shall be substituted the name set out opposite thereto in column (2).

(This note is not part of the Regulations)
These Regulations amend the Assured and Protected Tenancies (Lettings to Students) Regulations 1988 ("the 1988 Regulations"). Regulation 4A, as substituted, specifies all housing associations registered by the Housing Corporation or Housing for Wales as bodies for the purposes of paragraph 8 of Schedule 1 to the Housing Act 1988. A tenancy granted by such a body to a student or prospective student at an educational institution specified in the 1988 Regulations is not an assured tenancy for the purposes of that Act. Schedule 2 to the 1988 Regulations, as substituted, (which lists particular bodies specified for the purposes of the said paragraph 8) accordingly omits references to those bodies previously listed which are registered housing associations. Two bodies, the London School of Economics Housing Association and the London Mission (West London) Circuit Meeting of the Methodist Church, are also added to Schedule 2.l
Schedule 1 to the 1988 Regulations is amended so as to take account of the change in name of certain bodies already listed therein.
